i asked for prayer awhile back for my boy's girlfriend, she had her wisdom teeth out, then an ugly reaction, she recovered, thanks, my boy was very concerned that evening, i guess some time shortly after he passionately shared his concern with her, so i'm a grampa, with a shotgun, their getting married on oct/23 this year, i'm realising things aren't all about me, anymore, finally finding out how little control on anything, everything, we really do have,ever, Glory to my God, Redeemer, King... wow grampa...

Neighbor Don recently underwent a triple bypass, he is in 80's a navy WW2 vet and has good attitude towards recovery, but prayer is most important for him right now.

I am still looking for fulltime work, whatever God has for me is fine.

I keep my dog, Shiloh, a Chow Chow, on the screened-in back porch at night. When I went to feed and walk him this morning, I found him missing and the door propped open - I don't know if he was stolen, or if someone let him out for mischief. I suspect one of the neighborhood children, who is very troubled and who has been known to hurt animals. Please pray for Shiloh's safety and for his return. Thanks.

In June of 2006, our son, Josh Audette, then sixteen years old, was arrested for graffiti: unarguably an act of poor judgment with attendant consequences.  These consequences however, have spiraled into a series of misrepresented and reprehensibly unfair determinations which have terribly affected not only Josh, but our entire family.

While still a minor, Josh was interrogated by Naugatuck police, without benefit of legal counsel or parental oversight. It was implied to Josh that if full cooperation and truth were supplied, the courts would “go easy” on him.

An attorney, ‘Att. X’ [name withheld], was recommended to serve as our attorney, who assured us that this matter would be resolved in short order.  A retainer of $500 was accepted, however each court appearance was rendered, “to be continued,” in most part due to the unavailability of our attorney for representation. These court continuances were repeated several times, each at approximately two-week intervals. An associate of this attorney accompanied us for two hearings, neither of which provided the strongly suggested ‘resolution. This associate was later suspended for unscrupulous practice as well as allegations of domestic violence.  

In November, 2006, Josh was arrested for failure to appear, although we had gone to court on the date and time provided by Att. X, 2 PM, learning that Youthful Offender cases were heard in the morning as well as learning that both Att. X  and his associate had been suspended.  This ‘attorney error’ led to a fine of $250.  The total provided to Att. X was $1,500.

On July 13, 2007 we appeared in court for the final deposition: three years’ probation with Josh paying one-third of the $24,000 damages with no community service.  It was at this court session that I suffered a level of emotional and physic, al breakdown: when the judge told my so that he would pay an unexpected $69,000.  My reaction to this was not only to break into tears, but I began bleeding from my nose and mouth.  Paramedics were notified, but treatment was declined by me.  The judge then said that I was “only trying to scare him.” Although two others acted in association with Josh, neither has been arrested nor fined. They have been able to continue with their lives, which has resulted Josh receiving full consequences. 

A payment schedule was determined, $300 per month, which is a difficult sum for someone that age to manage.  My husband and I frequently assisted Josh with this payment and coupled with an increasingly difficult economy, Josh was unable to work for over one year.  When finally hired at a local Walmart, Josh’s payments were made in a timely and dutiful manner.  There was a further oral stipulation by his probation officer,Mr. Y that required attendance at drug classes and community service.  These were not included in the final deposition, of which I have copies of the court records.

Following his three years of probation, Josh was instructed by his PO, Mr. Y, to, “…just show up in court. You won't be arrested. But you have five hundred hours of community service and the total amount is $10,800."  At nine o’clock on Labor Day weekend of this year, Sept 4, 2010, the Nagatuck Police arrived at our home.  Josh was subsequently arrested and taken to the lock-up room at the police station, which is pretty much a cage, and bond was set at an amount which was impossible to secure on a holiday. Josh spent the night, and the entire following day until 4 PM which his case was finally called to court.   It is difficult and incongruous to witness repeated cases which included domestic violence and other violent offenders dismissed with minimal liability and security while my son was escorted in chains.

Josh’s legal interests at this time were provided by a ‘representative’ who permitted the pre-sentencing investigation (PSI) recommendation from the original prosecutor be used as evidence. This pre-sentencing material does not necessarily contain all of the facts and related material be submitted. This was essentially a “throw the book” at him punitive admonition, not the decision of the July, 2007 court.  The services of a public-defender were requested at this time, but we were told that as home owners, our financial position did not meet the criteria for such assistance.  While Josh continues to be a resident of our home, and is no longer a minor, his name is not associated with either our property or financial accounts.

It was communicated at this time by the judge and the corrections officers of the New Haven jail that the $2,250 would be submitted against his restitution, reducing his obligation.  If this were so, there is little to explain the need for incarceration.  There were many erroneous facts presented during this hearing: that there were three charges against Josh, that he did not remit payments, (although we possess receipts totaling $4,000), and that he had missed eight probation appointments, which was untrue.  There were numerous times which Josh had attempted to telephone Mr. Y to reschedule due to work related timing.  These calls were not answered, returned and messages were left though there was no call-back response.

It was also implied that since Josh had not been gainfully employed for one year, community service could have been performed, although again, this was not part of the July, 2007 court decision.  Additionally, in an exceptionally mean-spirited remark was made by this representative, “you’re going to jail.”

It was determined during this hearing of September 5, 2010 that $750.00 cash would be needed for each count, a total of $2,250 and that there would be no further incarceration. By the time this amount could be procured by family members, Josh had been taken to the Whaley Avenue Jail, where the $2,250 in cash was paid with a wait time of three hours.

A new court date was set at September, 22, 2010, and I had taken the day off to accompany Josh. On September 21, 2010, we received a letter that court was to be postponed until October 7, 2010.  At this time, I accompanied my son but was not permitted to either be present in the room or to speak.  We were prepared with cash to pay the balance of the fine as well as for the ruling of July, 13, 2010.  This ruling did not include community service time or drug classes, however, and we were not permitted to present this information.  Instead, another court date is scheduled for October 18, 2010 and Josh was instructed to secure legal representation as well as informed that he could potentially be serving four years of incarceration.

There are many things that are broken in the US, Connecticut and local governments.  The court systems are no exception.  Is justice truly served by the continually frustrated and prolonged oppression of one, who, as a minor, made a juvenile and poor decision, but whom, in the years following, has been subject to the far greater actions of our local justice system.

There have been numerous attempts to bring these repeated injustices to light. My personal retirement account will be expended to meet the last of these legal obligations, but I question the wisdom of incurring further personal debt if there is not only the possibility but also the likelihood continued misapplication.  In closing, it should be noted that the initial offending graffiti has not yet been repaired: where then, have these retribution funds been applied?

Your time is valuable, and your attention to this is greatly appreciated.  It is my hope that while our local courts have repeatedly failed in this issue, the court of public opinion and personal integrity will promote further investigation and conclusion to these years of mismanagement.

The latest: we have a new lawyer well voilà!! He defended Atty X when he was arrested! They're ALL in cahoots! We were NOT told that Josh could have said "I can't pay". This is how the other kids got off. We were told " pay 1/3 of the 24,000 damage, NOT pay the whole amount which the deposition states--"joint and separate-" meaning the whole amount. No one explained this. Supposedly we can sue the other 2 kids and have the case thrown out due to misrepresentation by our wonderful atty.

Yes, this and other BS makes me want to go into a coma.

Then the town wants to tax my house as a business!!! What do I make with this stupid candle thing? $6 a month!! I SPEND more than I make!!! It never ends!!! Someone must have reported me for running a big business out of my house. I wish it WAS. I'm never successful with any of these things.
